Welcome to the Homegrown National Park (“HNP”) website. We are excited to have you join our community and help further our Mission to regenerate biodiversity because all humans need healthy, productive ecosystems to survive. We value participation in our initiatives and hope that you will participate actively with the best of intentions. By accessing or using our website, including our online store, interactive map, image submission form, and resource directory, you agree to be bound by the following Terms and Conditions. Please read them carefully. If you do not agree, please do not use the site.

Acceptance of Terms
By accessing or using our website, app, or other online resources, you agree to use our resources to further our Mission, which will hopefully help you in your mission to regenerate biodiversity, and you agree to be bound by these Terms and Conditions, as well as any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of the site. HNP has the right to terminate and/or deny access to and use of any and all of our resources for any reason or no reason at all, with or without advance notice. If you are under the age of 18 years, make sure your parent or guardian is involved in your use of our materials. It’s a great way to grow your relationship with nature!

All the materials and information on our website, app, and other online resources are provided to you “as is” without any warranties. You must evaluate and bear all risks associated with your use, including risks associated with reliance on the accuracy, thoroughness, and usefulness of all the materials and information. HNP does not review, censor, approve, edit, or endorse information from users, and HNP cannot guarantee that inappropriate material will not be posted. We encourage all users to let us know if there is any information or material that is inappropriate so we can review and take action when necessary.

Online Store
HNP offers an online store where users may purchase HNP-branded gifts and products. All prices and products listed are subject to change without notice. By purchasing through our store, you agree to provide current, complete, and accurate purchase information. HNP is not liable for any issues arising from inaccurate information provided during the purchase process. Refund and return policies are outlined on our store page.

Interactive Map
The HNP map allows users to sign in and add their location and details about native plant coverage. We want the map to raise awareness, encourage participation, build community, show collective impact, and measure progress. By signing in and submitting information, you grant HNP permission to display these data publicly. You represent and warrant that all information provided is accurate and that you will not submit any offensive, illegal, or inappropriate content. HNP reserves the right to remove any content at its sole and complete discretion.

Image Submission
Users may submit images showcasing themselves and the native plants they care for. We want images to inspire and educate, showcase impact, and tell a story about how everyone can positively impact biodiversity. By uploading images, you promise that:

• You hold all necessary rights to the images, including all copyrights and other intellectual property rights and full permission and rights from any people in images
• All images you submit are accurate and not misleading
• You grant HNP a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, display, sublicense, and exploit any proprietary rights in the images, including on our website, social media, and in promotional materials
• You grant all other users a Creative Commons license to use your work with attribution, but not for commercial purposes (CC BY-NC)
• You will not upload any content that is offensive, defamatory, or infringes on third-party rights. HNP reserves the right to remove any submitted images that do not comply with these terms, or for any other reason, or for no reason at all.

Resource Directory
The HNP Resource Directory is provided as a public resource in support of our Mission to regenerate biodiversity and encourage ecosystem stewardship. The directory contains information submitted by listed entities and is intended as a guide for convenience only. By using the directory, you acknowledge that:

• HNP does not endorse the products, services, or practices of any listed entity.
• HNP has no control over any of the resources in the Resource Directory. Entities listed in the directory are solely responsible for the accuracy, completeness, and updates of their information.
• HNP disclaims any and all warranties of every kind, including regarding the accuracy, legality, or usefulness of the directory listings and HNP disclaims all liability and shall not be held liable for any losses or damages arising from reliance on the directory.

The operation of the Resource Directory relies on the honor system and community good-faith feedback to ensure listed entities align with HNP’s Mission. We appreciate everyone’s involvement. For concerns about a listing, please contact HNP at info@HomegrownNationalPark.org with relevant details.

Users of the directory are responsible for making independent assessments regarding the suitability of listed entities and products. The directory may not be downloaded or printed, but may only be used to search suppliers based on user-specified criteria.

Outside Links
HNP provides hyperlinks from the website to third-party sites as a convenience to users. HNP does not endorse such third parties or the contents of any such sites. HNP has no control over, makes no representation or warranty and disclaims all liability with respect to such sites.

User Conduct

You agree to use the Homegrown National Park website, apps, and its features solely in ways that support our Mission to regenerate biodiversity and foster a respectful, inclusive, and safe community. By accessing or using the site, you agree that you will not:

• Harass, bully, defame, stalk, threaten, or intimidate any individual or group, whether on the platform or by using information obtained through it.
• Submit or share any content that is obscene, profane, sexually explicit, racist, hateful, violent, or otherwise unlawful, including content that promotes or condones bigotry, discrimination, or harm of any kind.
• Use the site to promote or oppose political parties, candidates, ideologies, or religious beliefs, unless explicitly invited in a specific context.
• Solicit or publish anyone’s personal contact information, or attempt to collect personally identifiable information from other users.
• Upload, share, or distribute content or software that contains viruses, worms, spyware, or other malicious code.
• Use bots, spiders, or automated systems to scrape, crawl, or extract data from the site without written permission.
• Gain unauthorized access to any part of the platform or interfere with its functionality, infrastructure, or connected systems.
• Post or transmit any material that is false, misleading, defamatory, infringes on intellectual property or other rights, or violates any applicable laws or regulations.

Homegrown National Park reserves the right to remove content, restrict access, or take other appropriate action at its sole discretion to uphold these standards and protect the integrity of the platform.

Intellectual Property
All content on the HNP website, including trademarks, service marks, logos, images, text, graphics, and software, is the property of HNP or its content suppliers. Unauthorized use of our content is strictly prohibited.

Copyright Issues
We take copyright issues seriously and we comply with the Digital Millennium Copyright Act. If you believe your copyrighted work is being used on HNP without your permission, please email us at dmca@HomegrownNationalPark.org. We will promptly investigate the matter.

Privacy
Your use of the site is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information.

Limitation of Liability
HNP shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising out of your use of the website, the directory, or any services provided on the website, even if advised of such damages. Your sole remedy for dissatisfaction with the site or its content is to discontinue your use of the site.

Our website, app, and other resources are designed and intended for use in the United States of America (USA). If you use any of our resources outside the USA, you are responsible for complying with all applicable laws and regulations.
